Terms and Conditions of Service
evMega Technology Limited ("SnapCharge" or "we", "us", or "our") are pleased to give you (also referred to herein as "I") access to the SnapCharge Application (the " Application") along with other related or linked websites, applications, services, interfaces, tools, payment platforms, software, and other functionality provided on or through this Application (collectively, the "SnapCharge App") subject to your agreement to comply with these General Terms and Conditions.
By accessing or using the SnapCharge App, you agree to this Terms and Conditions Agreement, as updated from time to time. Accordingly, your use of the SnapCharge App constitutes acceptance of this Agreement and gives rise to a binding legal agreement between SnapCharge and you governing your use of the SnapCharge App.
1. CHANGES TO THE TERMS AND CONDITIONS
1.1 SnapCharge reserves the right, at our sole discretion, to change, modify, add, or delete portions of this Agreement at any time and without any further notice to you. It is your responsibility to regularly check for changes to this Agreement and to review such changes. Any new features or updated content or applications that we make available as a part of the SnapCharge App will be subject to this agreement. This Agreement is effective until terminated. You may terminate this Agreement for any reason by uninstalling the SnapCharge App.
1.2. All descriptions of services, service locations, products or product prices are subject to change from time to time without notice.
1.3 SnapCharge may limit, cancel, terminate or suspend the provision of Service at any time by notice to you:
(a) if you do not pay any amounts due for the Service;
(b) if the use of the Service exceeds the fair usage level set by us from time to time or is inconsistent with the [Fair Usage Policy] or our instructions;
(c) if there are technical difficulties or it is not feasible to provide the Service;
(d) if a third party supplier ceases to provide the goods or services which are necessary for us to provide the Service to you;
(e) if you or any other person use(s) the Service in contravention of any contract with you or for any illegal, unlawful or improper purpose, or you act in a way, which in our reasonable opinion, causes a nuisance or harassment to us or other customers;
(f) if we reasonably believe it is necessary to suspend the Service to: (i) comply with an order, instruction, determination, statement, direction or similar pronouncement of a government or regulatory authority; (ii) carry out scheduled maintenance, repair or upgrading of the Service, or any equipment, and facility.
1.4 This Agreement shall remain in effect until terminated. You may terminate this Agreement for any reason by uninstalling the SnapCharge Application.
2 ACCOUNT AND USAGE OF THE SERVICE
2.1 SnapCharge only collect very minimal information of you for normal functioning. While using the SnapCharge App, SnapCharge may locate or record information including, but not limited to, your geographic location and exact positioning, your register name and mobile phone number, charging transaction information.
2.2 Your use of the SnapCharge App constitutes your consent to allow SnapCharge to record and use the above Information.
3 Payments and Transactions
3.1 You agree to provide current, complete and accurate purchase and account information for all purchases made on the SnapCharge App, Service Plans or otherwise.
3.3 You agree to promptly update your account and other information, including but not limited to your email address, credit card number and expiration date, so that SnapCharge can complete your transactions and contact you as needed.
3.4 You must promptly pay all fees for the services, equipment and any other goods and services provided to you by SnapCharge without any deductions.
3.6 You shall not use or attempt to use the service or allow any person to use the service if the following circumstances occur when you use or attempt to use the service or allow any person to use the service:
(a) Is illegal, fraudulent, improper or unauthorized or used for unethical purposes;
(b) Will infringe or infringe upon the rights or privacy of others, including without limitation any intellectual property rights;
(c) Will cause annoyance, inconvenience or unnecessary anxiety to any person;
(d) Will modify, sublicense, sell or disassemble any part of the Equipment;
(e) Is inconsistent with the purpose of the service; or
(f) For your own or any party’s (excluding SnapCharge) commercial gain.
4. SnapCharge App Payments (if applicable)
4.1 Our platform accepts a variety of online payment methods and provides you with the payment transaction flexibility you need. You should pay attention to the terms and conditions of the corresponding payment services.
4.2 After you have plugged in your cable to evMega charger, the connection will be checked for safety automatically and you can then proceed to the payment selection screen. evMega charger accepts multiple means of digital online payments through SnapCharge App. You can pay by Octopus when there is an evMega’s Octopus Kiosk in the nearby or through SnapCharge App built-in multiple online payment services which are specially designed for you and are currently available.
5. Receipts and Statements (if applicable)
You will receive an e-receipt with the transaction details for each charging service. You can also check the balance of your SnapCharge App or review the recent transactions on your SnapCharge App.
6. E-Wallet Terms (if applicable)
6.1 After you complete charging, the system will automatically display the charging fee, remaining fee, and possible idle fee. The remaining fees will be automatically deposited into the virtual wallet of the SnapCharge App, and users can use the balance in the virtual electronic wallet to pay for charging fees.
6.2 The balance in the e-wallet cannot be returned, transferred, exchanged for cash or withdrawn as a cash advance.

8. Disclaimers and Limits of Liability
SnapCharge will not be liable to you for any damage, loss of income, business, goodwill, profits arising out of this Agreement, or any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.
9. Complaint Handling
If you have questions regarding your transaction history, or any correction, or if you dispute any transaction or correction that has been assessed against your SnapCharge App, please contact us by phone on (852) 2180 2400 and we will conduct an investigation and communicate the results and correct any error that we verify as soon as we finish the investigation. If no error was found, we will communicate an explanation. You should also exercise due care to monitor your transactions and account balances closely.

This Agreement is governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China. If there is any inconsistency between English and Chinese version, the English version shall prevail.
